I. INTRODUCTION

1.1 The website www.caseplease.com, further referred to as “CasePlease,” is owned and administered by the company SPROUT ENGINE S.R.L., bearing the following identification data: Unique Registration Code 36341432, registered at the Trade Register in Romania under number J40/9881/2016, with the head office on Calea Crangasi, no. 13, Camera 3, Bloc 11, Scara 2, Etaj 7, Ap. 71, sector 6, Bucuresti, Telephone :+40727572159, Email: contact@caseplease.com, with bank account no. RO96INGB0000999906081374, opened at ING Bank Office Crangasi, Calea Crangasi, nr. 18, Sector 6, Bucharest.

1.2 Browsing the site www.caseplease.com, followed by Order implies reading, understanding and accepting the terms listed below by any other Client.

1.3 Please read these Terms and conditions (further referred to as “Terms”) carefully before using the services offered by SPROUT ENGINE S.R.L. (further referred to as “CasePlease”), which will be defined herein after. These Terms and conditions include CasePlease's Privacy Policy, which is incorporated by this reference into these Terms.

Registering on the site and making an order implies the Client’s agreement regarding the reading, understanding and accepting the terms listed below.

1.4 This agreement is a mandatory contract and represents the parties’ will.

1.5 The provider has the right to change and update, at any given time, the content of this site, as well as the terms and conditions of use. The date of the last update of these Terms of Use is stated at the top of the page. Please review the Terms of Use periodically. We recommend that you print a copy of these Terms of Use for your records. The use of the services after the changes to the site and to these conditions represents the mandatory acceptance of those changes.

1.6 In case of misunderstandings or divergences between CasePlease and Client, the terms and conditions available at the moment of the order’s placement will be applied.

By accessing and/or using these services, the Client declares he is at least 18 years old.

II. DEFINITIONS

2.1 User - any person visiting the CasePlease site.

2.2 Client - natural person placing an Order.

2.3 Provider - the company SPROUT ENGINE S.R.L. bearing the following identification data: Unique Registration Code 36341432, registered at the Trade Register in Romania under number J40/9881/2016, with the head office on Calea Crangasi, no. 13, Camera 3, Bloc 11, Scara 2, Etaj 7, Ap. 71, sector 6, Bucuresti, Telephone: +40727572159, Email: contact@caseplease.com, with bank account no. RO96INGB0000999906081374, opened at ING Bank Office Crangasi, Calea Crangasi, nr. 18, Sector 6, Bucharest.

2.4 Order - an electronic document which enables the Provider and the Client to communicate, by means of which the Client intends on asking for the services offered by the Provider, through the site www.caseplease.com, as well as paying the necessary equivalent sum.

2.5 Contract - a firm Order made by the Client and confirmed by the Provider, by means of which the Provider agrees to offer their services and deliver the Products, and the Client agrees to purchase, receive and pay for these Products. The Contract is considered to be validly concluded after the Client makes the first payment by bank transfer towards CasePlease.

2.6 Services - the services offered by SPROUT ENGINE S.R.L. by means of the site www.caseplease.com (“site”), or any other service or property found under the partial or total control of SPROUT ENGINE S.R.L.

2.7 Visitor - natural person browsing the website www.caseplease.com, without purchasing services or making an order.

2.8 Released parties - category of parties that are excluded from responsibility, which includes CasePlease and its associates, employees, agents, partners, authorized parties and CasePlease successors.

2.9 Travel luggage - term defining all the objects included in an Order, which the Client deposits at the Provider according to the Contract.

III.INTELLECTUAL PROPERTY RIGHTS

3.1 The content of the site www.caseplease.com: images, texts, elements of web graphics, scripts, software, screening rights, model rights, patents, registered trademarks, is entirely the property of SPROUT ENGINE S.R.L. and defended by the Law regarding copyright and related rights as well as by the laws concerning intellectual and industrial rights.

3.2 The use of any of the above-mentioned elements without the permission of SPROUT ENGINE S.R.L. will be punished according to the law in force.

IV. PROVIDING SERVICES

4.1 The services offered by the Provider are as follows:

· The inventory of clothing items upon receiving them;

· Checking the garments in front of the Client to assess and note potential flaws;

· Picking up the clothing items from the Client.

· Engaging in cleaning, washing and ironing the garments;

· Safely and neatly depositing the garments of the Client in the specially conceived spaces;

· Optimally performing all the maintenance services until the handover to the Client;

· Preparing the garments to hand over to the Client, after cleaning and washing them;

· Handing over the clothing items to the Client at the established place, according to the order.

4.2 Forbidden and allowed items

● Clothing items (including footwear), personal items consisting of cosmetic and personal hygiene products ( toothpaste, toothbrush, soap, shampoo, and other hygiene or hair care products), as well as phone/tablet charger/USB cable are allowed.

● All the other items including, but not limited to: jewelry, medicine, flammable objects or materials, or items which can cause high risk situations are strictly forbidden. In the eventuality in which such objects will be found, CasePlease has the right to decide whether to return these objects at the Client’s expense, or discard these objects.

V. SERVICES OFFERED BY CASEPLEASE

5.1 The services offered by CasePlease include storing clothing (including footwear), personal use items (mentioned above) as well as phone/tablet charger/USB cable, left by the Client in the care of CasePlease.

5.2 CasePlease offers two plans for storing the Client's belongings:

● A smaller plan allowing the storage of up to 10 clothing items (including footwear), plus a toiletries bag, as well as a phone/tablet charger/USB cable. This plan costs 50 Euro per trip - details provided in Section IX.

● And a larger plan allowing the storage of up to 25 clothing items (including footwear), plus a toiletries bag, as well as a phone/tablet charger/USB cable. This plan costs 100 Euro per trip - details provided in Section IX.

5.3 All the articles will be stored in a specially designed space, in Bucharest, in optimal safety and hygiene conditions.

5.4 The clothing items will be cleaned by our third party providers, under the conditions imposed by them (Third Parties Terms) to their Clients.

5.5 CasePlease will make sure that the third party providers will meet their duties, according to the Third Parties Terms. Nevertheless, CasePlease is not responsible for any possible damages caused by the third party service providers.

5.6 The first step the Client has to take for using the CasePlease service consists in creating a user account on the site www.caseplease.com.

5.7 After creating the user account, the Client must sign in and fill in the personal profile on the CasePlease website (first name, last name, phone number, country, city, street number), as well as read and accept the Terms of Use (ToU). Filling in the profile and accepting the ToU are both mandatory for using CasePlease. Once accepting the ToU, the Client will receive a confirmation email. Afterwards, the Client must fill in the Payment Information section, before being able to use CasePlease. The Client will fill in the bank card number, CVV code and expiration date (month/year).

5.8 Before being able to make an Order of the CasePlease service, the Client must schedule a meeting with a CasePlease representative in Bucharest, to leave his desired clothing items and toiletries in CasePlease’ care. The Client will fill in a form containing the date and time of the meeting with the CasePlease representative and the hotel’s name and full address, where the Client has a reservation. Moreover, the Client will choose one of the two CasePlease plans, depending on how many clothing items (including footwear) he/she wishes to store (details at 5.2). Scheduling the meeting with the CasePlease representative can be booked at least 48 hours prior to the date and time filled in by the Client, in the form mentioned above. 5.9 After the Client meets the CasePlease representative and leaves his clothes and toiletries in CasePlease’ care, the actions mentioned in article 4.1 will proceed. Moreover, a hand over/take over report will be signed by the Client and a CasePlease representative. The hand over/take over report will include all the items the Client leaves in CasePlease’ care.

5.10 Once the Client’s belongings are in CasePlease’ care, the Client is able to make an Order of the CasePlease service. The Client must fill in a form on the CasePlease site when making an Order. Filling in the form is mandatory. This form will contain details about the Client’s arrival/departure date and time at/from the hotel in Bucharest, the name of the hotel and it’s address. The service can be booked at least 48 hours prior to the Client’s check in at the hotel in Bucharest. To make reservations after this deadline, please contact us at +40727572159 to see if we can meet your request.

5.11 For the Client’s round trips to Bucharest, for which CasePlease is used, the Client will find his luggage at the hotel’s reception. After delivering the Client’s luggage at the hotel’s reception, CasePlease will send the Client an email, confirming the delivery and listing the contents of the Client’s luggage, before the Client’s arrival time, stated in the online form. Similarly, at his departure, the Client will leave the luggage at the hotel’s reception, to be picked up by a CasePlease representative. After picking up the luggage, CasePlease will send the Client an email, confirming the pick up and listing everything found in the luggage.

5.12 The contents of the luggage may differ between hotel delivery and hotel pick up, since the Client can take some of his belongings back, or leave new items, up to the chosen plan’s limits (5.2).

5.13 CasePlease will hand over the Client’s luggage at the hotel’s reception, before the Client’s arrival time at the hotel, time declared in the order form. Similarly, CasePlease will take over the Client’s luggage from the hotel’s reception, after the Client’s departure day and time from the hotel, declared in the order form.

5.14 If the Client wishes to meet a CasePlease representative, and have his luggage delivered and/or picked up personally, by a CasePlease representative, he/she should send us an email at contact@caseplease.com, or call us at +40 727 572 159, with at least 48 hours prior to his/her arrival at the hotel, declared in the CasePlease online form. To schedule a meeting with CasePlease after this deadline, please call us at +40 727 572 159 to see if we can meet your request.

5.15 It is very important that the hotel room is registered under the same name the Client entered in CasePlease profile. Otherwise, the hotel may not accept the Client’s bag, if it does not have a registered guest under the Client’s name.

5.16 The Client's more delicate clothes (such as shirts, suits, skirts, dresses) will be delivered on hangers, protected by suit cover bags, while other items will be delivered in a CasePlease travel bag. Moreover, inside the CasePlease travel bag the Client will find his/her toiletries bag (300 x 180 x 140 mm), as well as a bag for underwear.

5.17 In the 300 x 180 x 140 mm cosmetics bag, the Client can opt for leaving cosmetics such as: shampoo, perfume, after-shave lotion, toothbrush, etc.

5.18 When the Client leaves his/her belongings at the hotel’s reception to be picked up by CasePlease, he/she will put everything in the CasePlease travel bag, and on hangers, if necessary.

5.19 Depending on the chosen plan (see 5.2 & 5.8), the Client can leave up to 10 clothing items (including footwear) with CasePlease for the smaller plan, or up to 25 clothing items (including footwear), for the larger plan. A pair of socks is considered one clothing item, a suit jacket another. Regarding the cosmetic and personal hygiene products, these must comfortably fit in the 300 x 180 x 140 mm cosmetic bag offered. Additionally, the Client can leave with CasePlease a phone/tablet/USB cable.

5.20 The Client can switch from the 50 Euro per round trip plan to the 100 Euro per round trip plan, or viceversa, anytime. The change can be done from My Profile section on the CasePlease website. Please note we might call you or email you to discuss any necessary details, regarding the new plan and the number of items you are storing with CasePlease.

VI. LIMITATION OF LIABILITY

6.1 The standard liability of CasePlease Company, which is implicitly applied to all Clients, for the lost or damaged luggage will not exceed the sum of 300 Euro/incident.

6.2 All the clothing items from the Luggage must have a label specifying the fabric and recommended cleaning methods. Only then, the provisions detailed above apply, in case of damage during the cleaning process. Otherwise, in case the fabric and recommended cleaning method details are missing, the items will be cleaned on the Client’s risk. In this situation, in case the articles will suffer any damage while being cleaned, CasePlease, as well as the third party partners will be exonerated from any liability.

6.3. As an exception, leather, suede and fur garments are processed on the Client’s risk, regardless of whether they do have or not a label with fabric and cleaning details. Color loss and other kind of damage may occur, due to inherent weakness of or defects in materials or workmanship that are not readily apparent prior to processing.

VII. MISSING, LOST OR DAMAGED LUGGAGE

7.1. After delivering the luggage at the hotel’s reception, CasePlease will email the Client, listing all the contents of his/her luggage. In the unlikely situation in which the Client’s CasePlease luggage has been mixed with another one, or contains different items than those belonging to the Client, CasePlease must be contacted at +40727572159 or via email at contact@caseplease.com, within maximum 4 hours after the Client’s arrival at the hotel, arrival time stated in the online form, or after the Client receives the email mentioned in the beginning of the paragraph (whichever occurs first). Otherwise, CasePlease and its partners will be exonerated from any liability.

7.2. After picking up the Client’s luggage from the hotel’s reception, CasePlease will email the Client, listing all the contents of his/her luggage. If the Client believes the items he/she left in the luggage are not the same as those stated in the CasePlease email, he/she must contact CasePlease at +40727572159 or via email at contact@caseplease.com, within maxium 8 hours after he/she receives the CasePlease email, listing the contents of the luggage. Otherwise, CasePlease and its partners will be exonerated from any liability.

7.3. CasePlease will use every effort to locate and deliver the Client’s Luggage or missing items, if that is the case.

7.4 If the Client believes that the items left in the care of CasePlease are lost or damaged, because of CasePlease services, the Client has to submit a complaint to the email address contact@caseplease.com, with the purpose of writing a request for compensation/reimbursement.

7.5 The request for compensation must be submitted within maximum 2 days from the date on which the Client returns from his/her last trip for which he/she used the CasePlease service.

7.6 All requests must include:

● A good faith estimate of the value of the lost or damaged Luggage,

● A detailed description of the lost or damaged luggage and

● Relevant supporting documentation. All the requests regarding damaged products must include illustrative photographs showcasing the damage. Moreover, all requests regarding lost products must include a proof of purchase/receipt.

7.7 Once CasePlease receives the complaint, we will see to your reimbursement request as soon as possible. During this process, CasePlease will be able to contact the Client to obtain further information. CasePlease can freely share information regarding the complaint with third party providers.

7.8 If the fault proves to belong to CasePlease or a third party provider, that the Products have been lost or damaged, then the Client will receive compensation by means of a credit release, which can be used within the services offered by CasePlease.

7.9 The CasePlease liability limit for lost or damaged luggage will not surpass the sum of 300 Euro/incident.

7.10 If the luggage is not found at the established place by the Client, the latter will contact CasePlease at +40727572159, so as CasePlease will use every effort to help the Client find the luggage.

VIII. SUBSCRIPTION AND SUBSCRIPTION TERMINATION

8.1 The subscription to the services offered by CasePlease is conditioned by the Client’s acceptance of these terms, by means of the procedure described in section I, and starts on the date the Client schedules the first meeting with CasePlease, to leave his/her clothes in CasePlease’ care (details in article 5.8). CasePlease can cancel the Client's subscription according to the description in Section XIV below.

8.2 The Client has the right to cancel the subscription to the services offered by CasePlease, by contacting the e-mail address contact@caseplease.com, where he/she will require the closing of the account. There are no cancellation fees involved, but no refunds will be provided for prorated periods, for the 5 Euro monthly fee.

8.3 In case the Client wishes to end his CasePlease subscription and stop using the service, he/she can either take his luggage at the end of his/her last trip with CasePlease, or have his/her luggage sent to him/her by post, within 12 work days, at his/her expense.

8.4 In case clothing items and toiletries are left in the care of CasePlease, without the Client using the service for six months, his/her account will be deactivated, and the products will be returned to the Client at his/her own expense, within 12 work days.

IX. SUBSCRIPTION'S VALUE AND MAKING THE PAYMENT FOR THE ORDERS

9.1 Throughout the subscription to the services offered by CasePlease, the Client will pay a monthly fee of 5 Euro, for storing his/her clothes and toiletries.

9.2 The subscription and the first payment of the monthly flat fee will take place right after the Client leaves his clothes and toiletries in CasePlease’ care. The Client authorizes CasePlease to immediately charge the monthly flat fee from his/her account, for the first month. The Client also authorizes CasePlease to automatically apply the 5 Euro monthly fee, to the Client’s card on file with CasePlease, on a monthly basis, for the following months.

9.3 For the first payment of the monthly flat fee, CasePlease will issue an invoice and email it to the Client, right after the Client leaves his clothes and toiletries in CasePlease’ care (detailed above). The invoice will contain the prorated value of the 5 Euro monthly fee, covering the number of days between the date of the meeting with the CasePlease representative, and the last day of that current month.

9.4 For the following months, the 5 Euro monthly fee will be automatically applied to the card on file with CasePlease, on a monthly basis. CasePlease will issue the invoice and make the 5 Euro charge during the 1st (first) day of each month and will email it to the Client.

9.5 Moreover, for each round trip in which the Client uses the CasePlease services, besides the 5 Euro monthly fee, he/she has to pay the price for the given Order. The price of the Order depends on the CasePlease plan the Client has chosen:

● 50 Euro per trip for the smaller plan, allowing the storage of up to 10 clothing items (including footwear), plus a toiletries bag, as well as a phone/tablet/USB cable.

● 100 Euro per trip for the larger plan, allowing the storage of up to 25 clothing items (including footwear), plus a toiletries bag, as well as a phone/tablet/USB cable.

The Order fee covers cleaning, ironing and transporting the Client's belongings.

9.6 When the client schedules and submits a new round trip (My Round Trips > Schedule Round Trip > Schedule Round Trip), he/she authorizes CasePlease to apply the 50 Euro or 100 Euro fee to the Client’s card on file with CasePlease, at the end of the round trip. The invoice for the Order will be issued and emailed to the Client, at the end of the roundtrip as well.

9.7 Invoices for both the monthly fee, and for the Order will have the values stated in Lei (or Ron – Romanian currency). The currency exchange rate from Euro to Lei will be made using BNR’s (The Romanian National Bank - http://www.bnr.ro/Home.aspx) official exchange rate of the day the invoice has been issued.

9.8 All CasePlease fees are quoted exclusive of any applicable taxes. The Client is solely responsible for paying any taxes of any kind imposed by any governmental authority with respect to his/her access to and use of the Services.

9.9 All payments you make towards CasePlease will be processed by a third party payment processor. Accordingly, CasePlease is not responsible for processing and/or collecting any payments and related taxes. You are solely responsible for complying with any applicable terms and conditions imposed by the third party payment processor. Under no circumstances will CasePlease be liable for any expenses or losses arising from any payment that you make through the Service.

9.10 The Client can easily cancel his/her subscription at any time, by emailing us at contact@caseplease.com. There are no cancellation fees, though no refunds are provided for prorated periods, for the 5 Euro monthly fee.

X. THE AVAILABILITY OF THE SHOWN SERVICES

10.1 The CasePlease offer regarding the services and their prices is available as long as it is shown on the CasePlease site.

10.2 Any changes concerning prices, the pricing model, or the availability of the services will be sent to the Client's user email. The use of the services after the change in these conditions represents the mandatory acceptance of these terms.

10.3 The CasePlease maintenance services are notified by site or email.

10.4 The Client is responsible with the update of the user account information, as soon as these changes occur.

10.5 The access to CasePlease service is available until the termination and/or erasing of the Client’s account, except for the cases in which the Client does not pay his/her monthly subscription, or does not pay the Orders. This access includes email assistance throughout the whole period of the present contract.

10.6. CasePlease makes all the efforts to permanently offer access to the services put at the Client’s disposal, but it can guarantee the availability of the services only to the extent of 99.8%.

10.7. The availability period does not include the periods for maintenance announced in advance via email or within the service; however, it does include the unannounced maintenance periods. As a result, taking into consideration the services’ dependency on the Internet access, possible system or technical limitations that might occur, CasePlease will have a diligence obligation regarding the availability of services, according to the above mentioned percentage.

10.8 If the Client could not access the service because of CasePlease over a period longer than that mentioned above, he/she can ask for a proportional reimbursement of the monthly subscription paid, for the period in which the service was not available.

10.9 In the case in which the requested service is not available anymore because of CasePlease, the Client will be notified and his/her Luggage will be sent to him/her by post, within 12 work days. If the required service is no longer available because of the Client (failing to pay, not respecting the contract, etc.), CasePlease has the right to hold the Client’s belongings until the Client pays the dues.

XI. PERSONAL DATA PROCESSING

11.1 These Terms and conditions include CasePlease's Privacy Policy, which is incorporated by this reference into these Terms.

11.2 CasePlease makes all efforts to ensure the confidentiality of the data received from the Client and filled in the user account.

11.3 Personal data will be used only for the site’s declared purpose. CasePlease is obligated not to make public or alienate the databases containing the Clients' personal data.

11.4 To benefit from the services, the Client must provide certain information to CasePlease.

11.5 CasePlease guarantees to respect the confidentiality of this information, as well as any laws regarding the protection of data.

11.6 The Client is the sole responsible person for disclosing his/her identification data to other persons, this being a severe case of negligence on the User’s side, in the situation where this disclosure would highly affect CasePlease.

XII. CLIENT'S RESPONSIBILITY

12.1 The Client is entitled to cancel the initial meeting with the CasePlease representative, the one for leaving his belongings in CasePlease’ care, or bring further adjustments to it, with at least 48 hours prior to the date and time of the meeting, filled in by the Client, in the online form. For canceling the meeting, or bring changes to it, the Client will notify CasePlease by phone at +40727572159, or by sending an email at contact@caseplease.com. For any adjustments after the deadline mentioned above, the Client will notify CasePlease by phone at +40727572159, to see if CasePlease can meet the request in due time.

12.2 Similarly, the Client is entitled to cancel the Order, or bring further adjustments to it, with at least 48 hours prior to his arrival time at the hotel in Bucharest, declared in the order form. For any changes to the order after this deadline, the Client will notify CasePlease by phone at +40727572159, to see if CasePlease can meet the request in due time. For cancelling the order after the above mentioned deadline, the Client will be responsible for damages added to 25% of the Order value.

12.3 The Client is the sole responsible for the existent content in his account, or for any law or third party person rights’ violation, regarding the services offered by CasePlease.

12.4 The Client must use the CasePlease services according to the law and knowing the legal provisions in force, regarding the activity in progress.

12.5 The Client must comply with the legal provisions on copyright and the protection of personal data regarding data introduced in the system.

12.6 The Client will process the personal data according to the legal provisions in force, and must obey the law in this field, and CasePlease cannot be held responsible for any prejudice or violations of any third party’s rights.

12.7 The Client agrees to use the service only according to its intended purpose, regarding the functionality offered and authorized under these terms. The Client must use this service according to the legal provisions regarding confidentiality, data protection, intellectual property, as well as other applicable laws in force. Moreover, the Client will respect:

a) With the exception of the case in which it is expressly provided in these terms, the Client agrees not to copy, reproduce, share, publish, show, and transmit any part of the service, without the permission of CasePlease.

b) The Client agrees not to interfere with the security system, or other characteristics of the service projected to control the manner in which the service is used.

c) The Client agrees not to do, cause, allow, authorize the translation, reverse engineering, the disassembly, or hacking of any part of the service, including any CasePlease Content available on, or through the service.

d) The Client agrees not to show or use any framing techniques regarding the service put at disposal by CasePlease, including any CasePlease Content available on or through the service, or any part of it, on any application or site.

e) The Client agrees not to give false information regarding the making of the account on the CasePlease site, or to usurp the identity of another person or entity in any way.

f) The Client will not create a new account on the CasePlease site, without the written consent of CasePlease, in case the existent account of the Client has been deactivated.

g) The Client will not restrict, discourage or prevent any person from using the CasePlease services.

h) The Client will not have unauthorized access to CasePlease services, will not use the accounts of other users, names or personal identification information, and will not have unauthorized access to other computers or sites connected to or related to the service.

i) The Client agrees not to post, broadcast or transmit in any other way, any virus or any other computer code, file or program which can, or is made to deactivate, overload, affect, damage or embezzle the functioning of any hardware, software or telecommunications equipment, or any other part of the equipment and service computers, or communication computers connected to the service.

j) The Client agrees not to interfere or interrupt the service, or the networks or servers connected to the service, or to violate the rules, politics or procedures regarding such networks or servers.

k) The Client agrees not to break the laws in force, or these Terms.

l) The Client is obliged not to use the service to make a product or a service competitive to that of CasePlease.

m) The Client agrees not to assist or allow any other person to engage in any of the activities described above.

Any violation of these restrictions leads to the Client’s obligation to damages, as well as his liability for violating the intellectual property rights.

XIII. CASEPLEASE RIGHTS AND OBLIGATIONS

13.1 CasePlease acts in the capacity of a host for the content added by the Client, under the provisions of Law 365/2002 regarding the electronic trade. CasePlease is not responsible for the loss of access passwords to the user account, or for any activities that might compromise the Client’s account.

13.2 If CasePlease receives a notification regarding the existence of apparently illegal services done by the Clients, it reserves the right to revoke the user’s account and end the collaboration with them.

13.3 If the uptime is under 99.8%, we will offer compensation percentage of the monthly subscription’s value, according to article 11.8.

13.4 CasePlease has the right to collect anonymous data about the way in which its services are used and to make them public aggregately.

13.5 CasePlease will ensure the access to its technical platform necessary for creating an account, managing and using the service. If the Client’s account is inactive for 6 months, it will be deactivated, the user’s data being erased.

13.6 CasePlease will offer email assistance (contact@caseplease.com) for problems related to the services offered to the Client, as well as phone assistance.

XIV. THE CONSEQUENCES OF VIOLATING THESE TERMS

14.1 If the Client does not act accordingly, CasePlease can forbid the use of the service.

14.2 CasePlease has the right to suspend or cancel the Client’s account, as well as preventing him/her from accessing the service because of any reason, at the discretion of CasePlease.

14.3 The Client is responsible for any pretenses, taxes, fines, penalties, as well as other liabilities bore by CasePlease, caused by, or which occur from violating these Terms and the use of this service.

XV. CASEPLEASE EXEMPTION FROM LIABILITY

15.1 The Client understands that he/she uses the service at their own risk, the parties not guaranteeing anything specific, either express or implicitly, including, but not limited to, commercial guarantees.

The exempted parties do not guarantee that:

● The CasePlease service will meet all the Client’s requests

● The service will be uninterrupted, safe, and without any errors

● The results that can be obtained after using the service will be exact, or will surpass any promised or provided results offered by a third party.

XVI. LIMITATION OF LIABILITY AND GIVEN COMPENSATIONS

16.1 CasePlease is not responsible for what happens with the Client when using the CasePlease service. If the Client uses the service in a way that would lead to CasePlease being involved in litigation, the Client will bear all legal taxes which might be imputed.

16.2 The Client understands and agrees that all parties exonerated from liability will not be held responsible for any incidents caused by:

(i) Using or not being able to use the service;

(ii) The cost of purchasing CasePlease services

(iii) Any other problem regarding CasePlease services

16.3 The Client will compensate the exonerated parties against any claims, actions or requests, including and not being limited to reasonable legal and accountant taxes, which occur from using the CasePlease service or from violating these terms.

XVII. FORCE MAJEURE

17.1 None of the contracting parties can be held responsible for not meeting (fully/partially) or for delaying in meeting their obligations, if these were caused by force majeure. The parties will inform each other as soon as possible about the force majeure and will take all the necessary measures to limit the consequences of the event.

17.2 If in 15 days the force majeure event does not cease, the parties have the right to denounce the contract unilaterally without asking for compensations.

Force majeure will be proven according to the law.

XVIII. SOLVING CONFLICTS. GOVERNING LAW

18.1 The contract will be governed and interpreted according to the Romanian law. Any conflict between CasePlease and Clients will be solved amicably. If this is not the case, the first solving manner is through mediation, under the provisions of the law, and if this fails, the Romanian competent courts from the CasePlease location will be called for.

18.2 The terms and conditions represent the full agreement between you and CasePlease regarding the Client’s use of the service, and they prevail over any previous oral or written agreements.

XIX. FINAL DISPOSITIONS

19.1 If any of the clauses above mentioned will be found null or invalid, this will not affect the validity of other clauses.

19.2 The provider has the right to change and update, at any given time, the content of this site, as well as the terms and conditions of use. The date of the last update of these Terms of Use is stated at the top of the page. Please review the Terms of Use periodically. We recommend that you print a copy of these Terms of Use for your records. The use of the services after the changes to the site and to these conditions represents the mandatory acceptance of those changes.
